1. ELIGIBILITY: MCE EV Charging offers a rebate to property owners/primary account holders (Customers) that install qualifying electric vehicle service equipment (EVSE). To be eligible to receive rebates through MCE EV Charging, Customers must: (1) Agree to the terms and conditions listed herein; (2) Have the EVSE metered through an MCE account number; and (3) Provide MCE with documentation showing (i) proof of purchase or invoice of qualified EVSE hardware, software, and networking services, and (ii) that the EVSE is operational.
2. REBATE AMOUNTS: The rebate amounts for qualifying EVSE are outlined in the MCE EV Charging materials. The rebate amounts may vary in accordance with MCE requirements. Rebate amounts reimburse the installation and/or hardware costs of Level 1 and/or Level 2 charging stations at workplaces, long-dwell sites, and multi-family properties, not to exceed 100% of the total installation and/or hardware costs after all rebates are applied. Rebates will be paid to eligible Customers once installation is complete and the EVSE is operational. For access to an upfront discount on the purchase price of EVSE, Customers may authorize the allocation of rebates to an approved vendor.
3. REQUIRED GENERATION SERVICE WITH MCE: Customer agrees that its EVSE shall be metered through an MCE account for a period of no less than 5 years after the installed EVSE is operational. Should Customer terminate MCE generation service for its EVSE meter within the first 5 years of the EVSE operation, Customer shall return rebate amounts received from MCE based on the following schedule: (i) 100% within the first two years; (ii) 75% between years 2 and 3; (iii) 50% between years 3 and 4; (iv) 25% between years 4 and 5. Replacement of an MCE-funded EVSE meter within five years is not eligible for an additional rebate.
4. DEEP GREEN BONUS REBATE: If Customer is a Deep Green customer, or opts up to Deep Green service, Customer may receive an additional Deep Green Bonus rebate per port. Termination of Deep Green service within the first 5 years requires return of 100% of the bonus rebate received.
5. SELECTION OF EVSE PACKAGE: Upon approval, Customer shall select and procure one EVSE Package from the approved vendor list. Customer is responsible for installation, operation, maintenance, and signage. MCE makes no representations regarding manufacturers, dealers, contractors, materials, or workmanship.
6. ADDITIONAL SERVICES FROM EVSP: EVSPs may offer additional services separate from MCE EV Charging. MCE is not responsible for EVSP service costs and does not guarantee increased rebate amounts due to additional services.
7. INSTALLATION OF EQUIPMENT: Customer is responsible for all upfront costs and ongoing operation and maintenance of installed EVSE.
8. EV DRIVERS RIGHT TO ACCESS: Customer may limit EVSE access but shall not discriminate on any basis prohibited by law.
9. ACCESSIBILITY REQUIREMENTS: Installation must comply with ADA and California Building Standards. MCE is not responsible for Customer compliance.
10. EVSE OPERATION AND MAINTENANCE: Customer bears all costs and responsibilities for EVSE uptime and maintenance. Service interruptions may occur.
11. BILLING: Customer must be the MCE customer of record and is responsible for all billing. EV charging pricing must be transparent, reasonable, and submitted to MCE for approval.
12. PERMISSION FOR MCE TO USE DATA: Customer permits use of non-usage data for regulatory reporting and business purposes.
14. CUSTOMER TO PROVIDE USAGE DATA TO MCE: Usage data must be provided annually or via network access and may be shared in aggregate form.
15. OTHER PROGRAMS AVAILABLE: Customer may be contacted regarding additional MCE programs.
16. TAX LIABILITY and CREDITS: MCE is not responsible for Customer tax obligations.
17. DISPUTES: MCE retains final determination authority.
18. PROGRAM CHANGES: MCE may modify or terminate the program while honoring existing commitments.
19. PROGRAM EXPIRATION: Program ends upon fund depletion or termination.
20. DISCLAIMER: No warranties are made regarding EVSE implementation or use.
21. INDEMNIFICATION: Customer agrees to indemnify and hold MCE harmless.
22. ACKNOWLEDGEMENTS: Customer shall acknowledge MCE as a funding source in public communications.
23. CUSTOMER AUTHORIZATION TO PLACE SIGNAGE: Customer agrees to placement of MCE-provided stickers per specifications.
24. CONSENT TO ELECTRONIC DISCLOSURE AND CONTRACTING: Customer consents to electronic records and signatures.
